The bass Hermanns was sued by opera director Leonard Grover for not fulfilling his contract to perform on a specific evening. Hermanns’s penalty was to pay $2500 for assessment of damage to Grover, which Hermanns appealed. He stated that when he received the subpoena, he inquired with Grover who told him to not worry about it. Therefore Hermanns did not follow up and was thus sentenced. The judge granted Hermanns an appeal if he would pay court costs and testify with a court reviewer.

Hermanns followed this order and now has a good chance of winning the case.
