“Paul Falk, the proprietor of the Tivoli Garden, in St. Mark’s place, was held in $1,000 bail by Justice Bixby, at Essex Market Police Court, yesterday, charged with disturbing the public peace by having a musical performance in his garden on the evening of Sunday last. He has been already arrested several times on complaint of the members of a church situated at the rear of his establishment. The complaint this time is made by ‘The Sabbatarian Committee,’ who are desirous of stopping all music in saloons and other places of common resort on Sunday evenings. Falk furnished bail and was discharged.”
