Maretzek in court vs. Guiseppi [sic] Ippolito, who sues “to recover the sum of $3,500 for services rendered as an operatic singer and moneys lent. Two motions were successively made by the defendant, one to compel plaintiff to file security for costs, and the other to strike out parts of the complaint, either as not conforming to the summons or as redundant. The Judge, in delivering his opinion, held that although the value of a half benefit which the defendant, as is alleged, guaranteed to the plaintiff, is fixed by the complaint, yet it is unliquidated, and that an application to the Court would be necessary. . . . The case was referred, by consent, to Judge Allen, and some interesting developments of the contentions and strife of the musical fraternity may be expected.”
