“It will be remembered that some months since Faustine Berthillot, a chorus singer of Batemans’ troupe, brought suit against Mr. B. for assault, and the case was tried without a jury, Judge Gross giving her $150 damages. Mr. B. the appealed to the General Term of the Marine Court, when the judgment against him was reversed, and a new trial ordered before a jury. The case was called on the 9th on appeal by Bateman from the previous decision, and it was set aside, and the original judgment affirmed.”
